Goodbye Trade Practices Act. Hello Competition and Consumer Act 2010.

The “Trade Practices Act” that we have come to know and love is having a face lift and changing its name! Under Schedule 5of the Trade Practices Amendment (Australian Consumer Law) Act (No.2) 2010, we are told that the so familiar Trade Practices Act will soon be referred to as the “Competition and Consumer Act 2010”.

Kindly, we have been given a little time to adjust to the change of identity. The date set for the name change is 1 January 2011; however, if Schedule 1 of the new laws has not commenced by 1 January 2011, the change will take place on the day of commencement. So, assuming everything goes according to plan, we will be adding a New Year’s resolution to the list- namely, to get our tongues around the new title!

Of course, the name-change is one of many amendments.  Important amendments relate to unfair contract terms, misleading or deceptive conduct, unconsionable conduct, unfair practices, consumer guarantees, unsolicited selling, lay-by sales, and the list goes on...
